1. Using Kinz’ Site and services

1.1.All use of and access to Kinz website at www.Kinz.com (Site)and the use of the related services offered on the site (services) are subject to these terms of services (TOS). By using or accessing the site or services, you agree to bound by these TOS. Kinz reserves the right to revise these TOS at any time, without prior notice, and you hereby agree to be bound by such changes.

1.2. Kinz graphics and database are the sole property of Kinz LLC. You may not, without a written permission from Kinz, take the results from a Kinz search and reformat display, republish, resell or otherwise abuse the data.

1.3. You may not remove the copyright or trademark notice from the content on the site or any material or information displayed or made available through the services.

1.4.You must not copy, reproduce, publish, broadcast, modify, distribute, sub-license or in any way commercially exploit any of the content on the site or made available through the services or make that content available via any network. You may not copy or modify the software used on or in relation to the site in any way.

1.5. All intellectual property rights in all materials, (including, but not limited to, text, videos, graphics, trademarks and logos) presented on the site or through the services are the property of Kinz, its licensors or other third parties and are protected under applicable laws. You must not infringe the intellectual property rights of Kinz, its licensors or other third parties.

2. Modification of these TOS

Kinz reserves the right to, at any time, change these TOS and any other terms, conditions, and notices under which Kinz services are offered, including but not limited to the charges associated with the use of site or services. You are responsible for regularly reviewing these TOS and all other terms, conditions and notices posted on the site. Your continued use of the site or Kinz services after modification of these TOS (and any other terms, conditions, and notices under which Kinz services are offered) constitutes your agreement to all such existing and modified terms, conditions and notices.

3. Advertising

Kinz shall not display any advertisement that contains materials which are obscene, inappropriate or contravenes applicable laws.

Kinz reserves the right to remove from the site any such advertisements.

You acknowledge and agree that, with reference to advertising services, Kinz operates on a "first come, first serve" basis.

4. Charges and fees

4.1. The service will be activated after you make the required payment to Kinz.

4.2. You acknowledge that charges must be paid in advance to cover the entire period of service usage and no refunds are payable by Kinz.

4.3. Invoices issued to you by Kinz are deemed accurate and conclusive evidence to the amounts owed by you to Kinz.

5. Termination

5.1. Kinz may terminate the subscription or stop the provision of a service immediately by notice in writing where (i) you breach any term of the TOS and the breach is not remedied within seven (7) days of notifying you; (ii) Kinz deems that you are abusing the service.

5.2. In the event that the subscription is terminated, or the provision of a service is stopped in accordance with clause 5.1, Kinz shall (i) retain all money paid for the service; (ii) be discharged from any further obligations under the conditions; and (iii) pursue any additional or alternative rights provided by law.

6. Control and liability disclaimer

6.1. Kinz shall not be responsible for any errors or omissions contained on this site or in the services and reserves the right to make changes to the site and the services without notice at any time and at its sole discretion. Accordingly, all Kinz and third-party information and the services are provided “AS IS’’ and Kinz expressly excludes all warranties of any kind, express or implied in relation to the site, the services or any goods or services advertised on the site or via the services. Kinz shall have no liability in relation to any contract to purchase any advertised goods or services.

6.2. In no event shall Kinz be liable for any damages whatsoever, including without limitation, direct, special, indirect, consequential, or incidental damages, or damages for lost profits, loss of revenue, or loss of use, arising out of or related to Kinz site or the information contained in it, whether such damages arise in contract, negligence, tort, under statue, in equity, at law or otherwise.

6.3. Some of the information which appears on the site or through the services is supplied by third parties. Any opinions, advice, statements, offers or other information expressed on the site or through the services are those of the authors and do necessarily reflect the views of Kinz. Kinz is not responsible or liable for the contract, accuracy or reliability of any material, advice, opinion, or statement made on the site or in connection with the services.

7. Information

7.1. Any information provided to Kinz in connection with Kinz site shall be provided by the submitter and received by Kinz on a non-confidential basis. You warrant that Kinz shall be free to use, modify, adopt copy, reproduce, publish, distribute, and display all information provided by you to Kinz on a free, perpetual, and unrestricted basis.

7.2. You agree that you will be responsible for any malfunction, damages or liability however arising for your submittal of any material that is inappropriate, profane, defamatory, obscene, indecent, or unlawful or that contains viruses, Trojan horses, worms, time bombs, corrupted files, or any other similar software or programs that may damage the operation of Kinz property.

7.3. You hereby grant an irrevocable license to Kinz to use, modify, adapt, copy, reproduce, publish, distribute, display, syndicate, and sub-license all information provided by you to Kinz on a royalty-free, perpetual, and unrestricted basis through- out the world. You agree that any and all content submitted to or available via Kinz may also be made available on hand-held devices, mobile phones or any other devices.

8. Member’s account, password and security

8.1. If any particular service offered on the site or any other Kinz owned website requires you to open an account, you must complete the registration process by providing Kinz with current, complete and accurate information as prompted by the applicable registration form. You then will choose a password and a username. You are entirely responsible for maintaining the confidentiality of your password and account. You must not disclose your password to any third party. Furthermore, you are entirely responsible for any and all activities that occur under your account whether these activities were executed by you and/or any of your employees or authorized persons, or due to your failure in maintaining the confidentiality of your password and account, or for any other reason so long as these activities have been executed under your account and/or by the usage of this account.

8.2. in addition to the above, you agree to notify Kinz immediately of any unauthorized use of your account or any other breach of security. Kinz will not be liable for any loss or damages that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Kinz or another party due to some-one else using your account or password.

9. unlawful or prohibited use

As a condition of your use of the site or any other services, you must not use the site or services for any purpose that is un-lawful or prohibited by these terms, conditions and notices. You must not use the site or other services offered in any manner that could damage, disable, overburden, or impair any Kinz service(s) or the network(s) connected to the site, any other Kinz site or the service(s) or interfere with any other party’s use and enjoyment of the site, any other Kinz site or the ser-vice(s). You may not attempt to gain unauthorized access to the site, any other Kinz site or the service, other accounts, computer systems or networks connected to any Kinz site/services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the site, any other Kinz sites or the service.

10. General

10.1. Kinz shall have no liability to you for any interruptions or delay in relation to the site or the services including, but not limited to, strikes, industrial disputes, war, riots, compliance with any law or governmental order or rule, fire, flood, or storm.

10.2. These TOS shall be governed by the laws of Jordan and hereby submit to the exclusive jurisdiction of the courts of Central Amman (Qasr Al Adel) in relation to any dispute regarding theses TOS.

10.3. These TOS together with any conditions Kinz may attach to any registration request form constitute the complete and exclusive understanding and agreement between you and Kinz and supersedes all prior understanding and agreements with respect to the subject matter of these TOS and any registration request form completed by you.

10.4. If for any reason a court of competent jurisdiction finds any provision of these TOS to be unenforceable, that provision will be enforced to the maximum extent permissible so as to effect the intent of the parties and the remainder of these TOS will continue in full force and effect.

10.5. Failure by either party to exercise any right or remedy under these TOS does not constitute a waiver of that right or remedy. Kinz does not waive any of its rights to enforce any provision of these TOS unless that waiver is in writing.

10.7. Kinz may assign, novate, or subcontract any or all of its rights under these TOS at any time you shall not be allowed to assign, novate or subcontract any rights or obligations under these TOS.

11. These TOS and conditions shall apply hand in hand with any other special written contractual arrangements and subscription, and in case of contradiction between these TOS and the special written contracts; the terms of the special written contracts shall apply.
